Acceptable Use Policy

This policy defines what you may and may not do with YanaHosts Africa services. Violations may result in immediate suspension.

1. Purpose

This Acceptable Use Policy ("AUP") governs the use of all services provided by Yana Technology Solutions CC trading as YanaHosts Africa. This AUP is incorporated into and forms part of our Terms & Conditions.

By using our services, you agree to comply with this AUP. We reserve the right to suspend or terminate services immediately for AUP violations, without refund.

2. Permitted Use

Our services are intended for lawful business and personal use, including:

  • Hosting legitimate business or personal websites
  • Running standard web applications (WordPress, CMS, e-commerce sites)
  • Sending transactional and commercial emails within anti-spam guidelines
  • Storing files and databases for your hosted applications
  • Operating standard web development tools within your allocated resources

3. Prohibited Content

You may not use our services to host, transmit, or distribute:

  • Child sexual abuse material (CSAM) or any content that exploits or harms minors
  • Illegal content under the laws of the Republic of Namibia or the country of your target audience
  • Hate speech, content promoting violence or discrimination based on race, gender, religion, or other protected characteristics
  • Copyrighted material without a valid licence or authorisation
  • Fraudulent, misleading, or phishing content
  • Malware, ransomware, spyware, or any malicious code
  • Content that violates the privacy of others, including non-consensual intimate imagery

4. Prohibited Activities

You may not use our infrastructure to:

  • Spam: Send unsolicited bulk email (spam), operate open mail relays, or harvest email addresses
  • Network abuse: Conduct port scanning, network probing, or denial-of-service (DoS/DDoS) attacks
  • Hacking: Attempt to gain unauthorised access to other systems, networks, or accounts
  • Cryptocurrency mining: Mine cryptocurrency or run scripts that consume excessive CPU resources
  • Resource abuse: Use resources in a way that degrades performance for other clients on shared infrastructure
  • Proxy / VPN abuse: Run anonymous proxy servers, TOR exit nodes, or VPN services without prior written approval
  • IRC servers: Operate IRC servers or bots
  • Illegal file sharing: Distribute pirated software, music, films, or other copyrighted works
  • Gambling: Operate unlicensed gambling platforms

5. Email Sending Rules

All email sent through our infrastructure must comply with:

  • Recipients must have opted in to receive communications from you
  • Every bulk email must include a valid unsubscribe mechanism
  • Your identity and physical address must be clearly disclosed
  • You must honour unsubscribe requests within 10 business days
  • Mass marketing email must be sent via a dedicated email marketing service, not our shared hosting email servers

We reserve the right to block or rate-limit outgoing email that generates spam complaints or triggers blacklisting.

6. Resource Usage

Our shared hosting plans allocate a fair share of server resources. You agree not to:

  • Run long-running or scheduled processes that consume excessive CPU or memory
  • Upload files solely for backup or storage purposes unrelated to a hosted website
  • Use your hosting account as a file distribution network or CDN

If your resource usage adversely affects other clients, we may throttle, suspend, or require you to upgrade to a higher plan.

7. Security

You are responsible for the security of your hosting account, including:

  • Keeping all CMS installations (WordPress, etc.) and plugins updated
  • Using strong, unique passwords for cPanel, FTP, and database access
  • Promptly reporting any suspected compromise of your account to us

Accounts compromised due to client negligence (e.g. weak passwords, outdated software) may be suspended until remediated. Recovery assistance may incur fees.

8. Enforcement

8.1 We monitor our network for AUP violations. We may investigate complaints from third parties or reports of abuse.

8.2 Violations may result in:

  • A written warning and request to remedy
  • Temporary suspension of services
  • Permanent termination without refund
  • Reporting to law enforcement where required by law

8.3 We reserve the right to act immediately and without prior notice for serious violations (e.g. CSAM, active hacking, DDoS).

9. Reporting Abuse

If you believe our infrastructure is being used in violation of this AUP, please report it to:

Include: the offending URL or IP, a description of the issue, and any supporting evidence.

We take abuse reports seriously and will investigate within 24 business hours.

10. Changes to This Policy

We may update this AUP at any time. Changes are effective immediately upon posting. Continued use of our services constitutes acceptance of the revised AUP.
