Terms & Conditions

• "Company", "we", "us", "our" — Yana Technology Solutions CC (Reg. CC/2019/02333), trading as YanaHosts Africa
• "Services" — Web hosting, email hosting, domain registration, website design, and related services offered by YanaHosts Africa
• "Client", "you", "your" — The individual, company, or organisation purchasing or using our Services
• "Agreement" — These Terms & Conditions, together with any order form, invoice, or service agreement
• "Content" — Any data, files, websites, emails, or other material hosted on our infrastructure

By placing an order, making payment, or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and our Acceptable Use Policy.

If you are ordering on behalf of a company or organisation, you confirm that you have authority to bind that entity to these terms.

3.1 Service Description. We provide shared web hosting, email hosting, domain registration, website design, and related digital services as described on our website.

3.2 Provisioning. Hosting accounts are provisioned manually within 24 business hours of confirmed payment. Domain registration is subject to registry processing times.

3.3 Service Modifications. We reserve the right to modify, update, or discontinue any service with reasonable notice. We will provide at least 30 days’ notice for material changes or service discontinuation.

3.4 cPanel Hosting. All hosting plans are cPanel-based shared hosting. Resources are shared with other clients on the same server. You may not use resources in a way that adversely affects other clients.

4.1 Pricing. All prices are in Namibian Dollars (NAD) and exclude 15% VAT unless otherwise stated.

4.2 Payment Method. Payment is by Electronic Funds Transfer (EFT) to our Bank Windhoek business account. Details are provided on your invoice.

4.3 Payment Confirmation. Services are activated upon confirmed receipt of payment. Please use your unique order reference on your EFT payment.

4.4 Renewals. We will send renewal invoices by email and WhatsApp before your service expiry date. You are responsible for ensuring timely payment to avoid service interruption.

4.5 Late Payment. Services not renewed within 7 days of expiry may be suspended. Services not renewed within 30 days of expiry may be terminated and data deleted without further notice.

5.1 Registration. Domain registrations are subject to the rules of the relevant registry (e.g. ZACR for .co.za, ICANN for .com). We act as your registrar agent.

5.2 Ownership. Domain names registered on your behalf remain your property. Your contact details will be recorded as the registrant.

5.3 Transfers. Domain transfers away from YanaHosts are permitted at any time after the initial 60-day lock period imposed by registries. Transfer fees may apply.

5.4 Renewals. You are responsible for renewing domain names before expiry. We are not liable for loss of a domain name due to non-renewal.

You agree to:

• Provide accurate and complete information when placing orders
• Keep your login credentials secure and not share them with unauthorised parties
• Comply with our Acceptable Use Policy at all times
• Maintain current and accurate contact information
• Ensure that Content hosted on our platform is lawful and does not infringe third-party rights
• Maintain your own backups of important data (backups provided by us are supplementary, not a substitute)

Use of our Services is subject to our Acceptable Use Policy, which is incorporated into these terms by reference. Violation of the AUP may result in immediate suspension or termination without refund.

8.1 By Us. We may suspend or terminate your account immediately and without notice if you:

• Violate these Terms or the Acceptable Use Policy
• Engage in activity that threatens our infrastructure or other clients
• Fail to pay within the grace period
• Provide fraudulent or false information

8.2 By You. You may cancel your services at any time by contacting us. Refunds are governed by our Refund Policy.

8.3 Data on Termination. Upon termination, we will retain your data for up to 14 days before deletion. You are responsible for retrieving your data before termination takes effect.

We aim to maintain 99.9% uptime as described in our SLA Agreement. Scheduled maintenance and circumstances beyond our control are excluded from uptime calculations.

To the maximum extent permitted by Namibian law:

• We are not liable for indirect, incidental, special, or consequential damages arising from use of our Services
• Our total liability for any claim arising from these terms shall not exceed the amount paid by you for the relevant service in the 3 months preceding the claim
• We are not liable for data loss resulting from client error, third-party actions, or circumstances beyond our reasonable control

You retain ownership of all Content you host with us. By hosting Content, you grant us a limited licence to host, store, and transmit that Content solely to provide the Services.

All intellectual property on yanahosts.com (design, code, branding, text) belongs to Yana Technology Solutions CC and may not be reproduced without permission.

Website design projects are governed by separate project agreements. Payment milestones, timelines, and deliverables will be specified in writing before work commences. Design work not collected or approved within 30 days of completion notice may be considered accepted.

These Terms are governed by the laws of the Republic of Namibia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Windhoek, Namibia.

We reserve the right to update these Terms at any time. Updated terms will be posted on this page with a revised effective date. Continued use of our Services after changes constitutes acceptance. Material changes will be notified by email.
